I made the assumption that both parents are malfeasant aliens, which is not always the case--I am certain since 1997 that some of them have enlisted legal aliens or US citizens into their scheme (from possible personal experience with such an attempt in Dallas).
For that case, the same approach (fine of US$100,000 + interest--with the interest accruing at credit-card rates, and bar on re-entry into US until this is paid-in-full--for first-time-caught malfeasant parent; lifetime ban and much heftier fine of $500,000 for multiply-caught malfeasant) can still be applied, with the legal-alien (or USC) parent gaining automatic custody of the child.
(this one, I mulled over for far more than the five minutes for the previous).
